2. Eligibility and accounts
You must be at least 16 and able to enter a binding contract. You are responsible for keeping your credentials secure and for activity under your account. One account per person; accounts are personal and not transferable.
3. What you are buying
A free tier and two one-time purchases are offered: Starter and Elite, at the prices shown on the pricing page. There is no subscription and no recurring charge. Payment is taken by Stripe. A purchase grants a single person access to the tier bought: 12 months of access, starting on the purchase date, including updates released during that access period.
4. Refunds
Our 7-day money-back guarantee is explained in section 11 (Australian Consumer Law) and applies in addition to your rights under the Australian Consumer Law. We don't offer refunds based on your test result.

9. Limitation of liability
Subject to section 11 (Australian Consumer Law), and except for liability for a failure to comply with a consumer guarantee, to the maximum extent permitted by law, our total liability arising from the Service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited, including your statutory consumer rights.
10. Suspension and termination
We may suspend or close an account that breaches section 5. You may close your account at any time from your profile, or by emailing us; see the Privacy Policy for deletion.
11. Australian Consumer Law
(a) Your consumer guarantees. If you are a consumer in Australia:
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
(b) These Terms do not take those rights away. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified. If any other part of these Terms – including the sections on refunds, "no promise of outcome", limitation of liability, changes and governing law – would have that effect, it does not apply to the extent that it would.
(c) How our 7-day money-back guarantee fits in. Our 7-day money-back guarantee is an extra promise on top of your rights under the Australian Consumer Law. If you ask for a refund within 7 days of a charge, we refund that charge in full – you don't need to give a reason, so it also covers a change of mind. To ask, email [email protected] from your account email address. We refund to your original payment method within 14 days of your request. After those 7 days we do not give refunds simply because you changed your mind or because of your result in the real test. That does not affect your rights under paragraph (a): if our product fails to meet a consumer guarantee, you can claim a remedy from us under the Australian Consumer Law, whether or not the 7 days have passed.
(d) Governing law. The governing-law section of these Terms does not stop the Australian Consumer Law from applying to your contract with us.
12. Governing law
The Service is operated by PassToTeach.com, registered at 30 N Gould St Ste R, Sheridan, WY 82801, United States. These terms, and any dispute arising from them or from the Service, are governed by the laws applicable where PassToTeach.com is registered, and the courts located there have jurisdiction. If you are a consumer, this does not remove your right to bring a claim in the courts where you live.
13. Changes
If we make a change that materially disadvantages you during a paid access period, we will tell you by email at least 30 days in advance, and you may cancel and receive a pro-rata refund for the unused portion.
